Terms of Use (ToU)

Acceptance Required

By using our trading SaaS services, you unreservedly accept these Terms of Use. If you do not accept these terms, you must not use our services. Effective date: August 25, 2025

Article 1 - Definitions

In these Terms of Use, the following terms have the meaning set out below:

  • "Service" or "SaaS" : All online trading tools offered by PropFirmsCodes
  • "User" : Any natural or legal person who has subscribed to a subscription
  • "Account" : Secure personal space allowing access to the Service
  • "API" : Programming interface allowing integration with third-party services
  • "Data" : Any information entered, generated or processed via the Service
  • "Content" : Texts, images, videos, strategies and analyses available

Article 2 - User Account

2.1 Account Creation

To access the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Create a secure password (minimum 8 characters)
  • Validate your email address
  • Accept the Terms of Use and Terms of Sale

2.2 Account Security

Your responsibilities:

  • Keep your credentials confidential
  • Do not share your account with third parties
  • Enable two-factor authentication (recommended)
  • Inform us immediately of any unauthorized access
  • Change your password regularly

2.3 Limitations

  • One account per natural person
  • Prohibition of creating multiple accounts
  • No shared or collective accounts (except Enterprise plan)
  • Simultaneous connections limited according to plan

Article 3 - Acceptable Service Usage

3.1 Authorized Usage

You are authorized to:

  • Use the Service for your personal trading
  • Analyze and optimize your strategies
  • Export your personal data
  • Integrate via API according to your plan limits
  • Use analysis and backtesting tools

3.2 Prohibited Usage

⚠️ It is strictly prohibited to:

  • Resell or redistribute the Service
  • Use the Service for illegal activities
  • Attempt to bypass technical limitations
  • Massively extract data (scraping)
  • Intentionally overload servers
  • Share copyrighted content
  • Manipulate or falsify trading data
  • Use the Service for spam or phishing
  • Create unauthorized robots or automated scripts
  • Access other users' accounts

3.3 Fair Use Policy

Usage limits according to your plan:

  • Basic: 1000 API requests/day, 10GB storage
  • Pro: 10000 API requests/day, 100GB storage
  • Enterprise: Unlimited (within reasonable limits)

Article 4 - API and Integrations

4.1 API Access

  • Personal and secure API keys
  • Complete technical documentation provided
  • Rate limiting according to your plan
  • Webhooks available for Pro+ plans

4.2 API Usage Rules

  • Do not share your API keys
  • Implement client-side caching
  • Respect rate limits
  • Use HTTPS exclusively
  • Handle errors properly

4.3 Third-Party Integrations

Available integrations with:

  • TradingView
  • MetaTrader 4/5
  • NinjaTrader
  • Interactive Brokers
  • Other platforms via REST API

Article 5 - Data and Content

5.1 Your Data

  • You remain the owner of your trading data
  • Right to export at any time
  • Permanent deletion upon request
  • No commercial use without agreement

5.2 Our Content

We remain owners of:

  • Algorithms and predefined strategies
  • Proprietary technical indicators
  • Educational content and training
  • Interface and user experience
  • Aggregated market data

5.3 Content License

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use your data solely for:

  • Service provision
  • Algorithm improvement (anonymized data)
  • Generation of aggregated statistics
  • Technical support

Article 6 - Confidentiality and Security

6.1 Data Protection

  • AES-256 encryption for sensitive data
  • SSL/TLS for all communications
  • Secure and audited servers
  • Daily encrypted backups
  • GDPR and CCPA compliance

6.2 Security Incidents

In case of data breach:

  • Notification within 72 hours
  • Detailed information about the incident
  • Immediate corrective measures
  • Dedicated support for affected users

6.3 Audit and Compliance

  • Quarterly security audits
  • Annual penetration testing
  • SOC 2 certification (in progress)
  • Bug bounty program

Article 7 - Availability and Performance

7.1 Service Level Agreement (SLA)

  • Guaranteed availability: 99.9%
  • API response time: < 100ms (P95)
  • RTO (Recovery Time Objective): 4 hours
  • RPO (Recovery Point Objective): 1 hour

7.2 Maintenance

  • Scheduled maintenance: Sunday 2am-4am UTC
  • 48h advance notification
  • Emergency maintenance without notice possible
  • Status page: status.propfirmscodes.com

7.3 Compensation

In case of SLA non-compliance:

  • 99.9% - 99.0%: 10% credit
  • 99.0% - 95.0%: 25% credit
  • < 95.0%: 50% credit

Article 8 - Suspension and Termination

8.1 Account Suspension

We may suspend your account in case of:

  • Violation of Terms of Use or Terms of Sale
  • Suspicious or fraudulent activity
  • Non-payment after reminder
  • Excessive exceeding of usage limits
  • Abusive behavior towards support

8.2 Suspension Procedure

  1. Email notification with reason
  2. 48-hour deadline for regularization
  3. Possibility to contest the decision
  4. Effective suspension after deadline
  5. Data retention for 30 days

8.3 Permanent Termination

Causes for immediate termination:

  • Hacking or piracy attempts
  • Reverse engineering of the Service
  • Unauthorized resale
  • Identity theft
  • Repeated violations after warnings

Article 9 - Responsibilities and Warranties

9.1 Our Commitments

  • Provide the Service in accordance with the description
  • Ensure data security
  • Respect confidentiality
  • Keep the Service updated
  • Provide technical support

9.2 Warranty Exclusions

The Service is provided "as is". We do not guarantee:

  • Complete absence of errors or bugs
  • Compatibility with all systems
  • Trading results
  • Absolute accuracy of analyses
  • 100% availability

9.3 Limitation of Liability

Our liability is limited to:

  • Maximum: amount paid over the last 12 months
  • Exclusion of indirect damages
  • Exclusion of profit losses
  • Exclusion of data losses (except negligence)

9.4 Trading Warning

⚠️ IMPORTANT WARNING:

  • Trading involves high risks
  • Past performance does not guarantee future results
  • Our tools are decision aids only
  • You are solely responsible for your trading decisions
  • Never trade with money you cannot afford to lose

Article 10 - Terms of Use Modifications

10.1 Right to Modification

We reserve the right to modify these Terms of Use at any time to:

  • Comply with legal developments
  • Improve security
  • Add new features
  • Clarify certain points

10.2 Notification

  • Email 30 days before effective date
  • In-app notification
  • Blog publication
  • Acceptance required to continue usage

10.3 Refusal of Modifications

If you do not accept the new Terms of Use, you can:

  • Cancel your subscription
  • Export your data
  • Request account deletion

Article 11 - Final Provisions

11.1 Entire Agreement

These Terms of Use, along with the Terms of Sale and Privacy Policy, constitute the entire agreement between you and The Planet Deals LLC.

11.2 Severability

If a provision is deemed invalid, the other provisions remain applicable.

11.3 Non-Waiver

Failure to exercise a right does not constitute a waiver of that right.

11.4 Force Majeure

We are not responsible for failures due to events beyond our control (natural disasters, wars, pandemics, major Internet outages, etc.).

11.5 Language

In case of translation, the English version prevails for interpretation.

Article 12 - Applicable Law and Disputes

12.1 Applicable Law

These Terms of Use are governed by the laws of the State of Wyoming, United States, without prejudice to mandatory consumer protection provisions.

12.2 Dispute Resolution

  1. Attempt at amicable resolution (30 days)
  2. Mediation if necessary
  3. Arbitration under AAA rules
  4. Wyoming courts as last resort

12.3 EU Consumers

EU consumers may use the ODR platform: https://ec.europa.eu/consumers/odr
